Screel Terms of Service

Effective Date: January 1, 2026

These Terms of Service ("Terms") govern your access to and use of the Screel website, applications, and related services (collectively, the "Service"), operated by Screel, Inc. ("Screel," "we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not access or use the Service.

1. Eligibility and Accounts

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use the Service.

You agree to:

  • Provide accurate and complete account information
  • Maintain the security of your account credentials
  • Be responsible for all activity conducted through your account

Screel is not responsible for unauthorized access resulting from your failure to safeguard credentials.

2. Description of the Service

Screel provides AI-powered tools that enable users to generate, visualize, and assemble images, videos, and other creative media.

You acknowledge and agree that:

  • Outputs are generated algorithmically and automatically
  • Screel does not review, verify, or endorse user content or AI outputs
  • Outputs may be inaccurate, incomplete, misleading, or inappropriate
  • Screel does not provide legal, professional, or rights-clearance advice

3. User Content and Intellectual Property

3.1 Definitions

  • Input: Any content you submit to the Service
  • Output: Content generated by the Service in response to Input

3.2 Ownership

As between you and Screel, and to the extent permitted by law:

  • You retain ownership of your Input
  • You own your Output

Screel does not claim ownership of Outputs.

3.3 License to Operate the Service

You grant Screel a non-exclusive, worldwide, royalty-free license to use, host, process, reproduce, and display Input and Output solely for:

  • Operating and improving the Service
  • Providing features you request
  • Ensuring safety, compliance, and abuse prevention

This license terminates when content is deleted, except where retention is required by law or legitimate business needs.

3.4 No Guarantee of Uniqueness

You acknowledge that:

  • Outputs may not be unique
  • Similar or identical content may be generated for other users
  • Screel does not guarantee exclusivity or non-infringement of Outputs

4. Acceptable Use Policy (AUP)

You agree not to use the Service to create, upload, generate, or distribute content that:

4.1 Illegal or Harmful

  • Violates any applicable law or regulation
  • Facilitates violence, terrorism, or criminal activity
  • Exploits or harms minors
  • Contains sexual content involving minors

4.2 Intellectual Property and Personal Rights

  • Infringes copyrights, trademarks, or other proprietary rights
  • Misappropriates trade secrets
  • Impersonates individuals or entities without authorization
  • Uses a person's likeness without consent where required

4.3 Deceptive or Abusive Conduct

  • Produces false or misleading information presented as fact
  • Enables scams, fraud, or impersonation
  • Harasses, threatens, or abuses others

4.4 Platform Misuse

  • Attempts to reverse engineer or extract models
  • Circumvents safeguards or rate limits
  • Uses automated access without authorization
  • Interferes with system security or integrity

Screel reserves the right to remove content, suspend or terminate accounts, and take other appropriate action at its sole discretion.

5. User Responsibility

You are solely responsible for:

  • Your Inputs
  • Your Outputs
  • How Outputs are used, shared, or commercialized

You are responsible for reviewing Outputs before public or commercial use.

6. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCREEL DISCLAIMS ALL WARRANTIES, INCLUDING:

  • Accuracy
  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement

SCREEL DOES NOT WARRANT THAT OUTPUTS WILL BE ERROR-FREE, LAWFUL, OR SUITABLE FOR ANY PARTICULAR USE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

SCREEL SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

SCREEL'S TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:

  • AMOUNTS PAID BY YOU TO SCREEL IN THE 12 MONTHS PRIOR TO THE CLAIM, OR
  • USD $100

8. Indemnification

You agree to indemnify, defend, and hold harmless Screel and its officers, directors, employees, and contractors from any claims, damages, liabilities, and expenses arising from:

  • Your use of the Service
  • Your Inputs or Outputs
  • Your violation of these Terms
  • Your infringement of third-party rights

9. Suspension and Termination

Screel may suspend or terminate access immediately if you violate these Terms or misuse the Service.

Termination does not limit Screel's legal rights or remedies.

10. Changes to the Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of the State of California, excluding conflict-of-law principles.

13. DMCA / Copyright Infringement

Screel respects the intellectual property rights of others and expects users to do the same.

If you believe that content on Screel infringes your copyright, you may submit a copyright infringement notice ("takedown notice") containing all required information under the Digital Millennium Copyright Act (DMCA). At minimum, the notice must include:

  1. Your physical or electronic signature
  2. Identification of the copyrighted work claimed to be infringed
  3. Identification of the content on Screel claimed to be infringing
  4. Your contact information (address, telephone number, and email)
  5. A statement that you have a good-faith belief the use is unauthorized
  6. A statement under penalty of perjury that the information in the notice is accurate

Upon receiving a valid DMCA notice, Screel will:

  • Remove or disable access to the allegedly infringing content promptly
  • Notify the user who uploaded the content
  • Terminate accounts of repeat infringers in accordance with our Acceptable Use Policy

This procedure is designed to provide Screel with safe harbor protection under the DMCA.
